Freight Policy

Prices stated are F.O.B. Rio Hondo, TX. Other terms and conditions may apply for other than standard ground delivery, including without limitation, expedited same day delivery, air freight, freight collect, export orders, hazardous materials, LTL, customer's carrier, shipments outside the contiguous U.S. or other special handling by the carrier. Any charges incurred for other freight services must be paid by customer. Fuel surcharges may be applied. Title and risk of loss pass to customer upon tender of shipment to the carrier. If the product is damaged in transit, customer's only recourse is to file a claim with the carrier. 

Notices

Delta Heat LLC (Delta Heat) standard terms and conditions in effect at the time an order is accepted (including as to limited warranties and limitations of liability) apply to all purchases. We do not accept any deviations from these terms.

This website contains many specifications, wiring diagrams and other types of information related to the various product offerings. However, under no circumstances should you use this information for installation, operation, or troubleshooting of any equipment.

Always consult the appropriate product documentation prior to using the equipment. If you have any questions concerning the installation or operation of this equipment, or if you need additional information, please e-mail Customer Service.

Ordering

U.S. Customers Only

Customers can place orders via the phone or email for direct shipment. Customers must supply a credit card, a valid shipping address, phone number, and email address in order for their order to be accepted. All payment is accepted in U.S. dollars (USD) only.

Customers outside the U.S.

Customers outside the U.S can place an order request through our catalog. However, due to contractual agreements with some of our suppliers, not all products we offer are available outside the U.S.

U.S. or International Law may prohibit the shipment of some products. For all products eligible for international shipping, export shipping charges will apply.

Online Order Processing

Your order is entered into our business system automatically. You will receive an order confirmation to the e-mail address provided after we receive your order. Our goal is to ship standard products within three (3) days, but lead times for custom orders will need to be discussed with customer service. 

General Terms

1. Intellectual Property

Customer shall have no right, title, or interest in the trade names, trademarks, trade dress, copyrights, patents, domain names, product names, catalogs or any other intellectual property rights reserved by Delta Heat, or any trademarks or service marks owned by suppliers to Delta Heat. All materials contained on Delta Heat's website are subject to the ownership rights of Delta Heat and its suppliers. Customer shall have no right to copy or use any of the intellectual property of Delta Heat or its suppliers without permission.

2. Cancellation

All product order cancellations must be approved by Delta Heat, and may be subject to restocking fees and other charges. Only standard products that have not been shipped or custom heaters not in process can be canceled. Notify Customer Service immediately if the order needs to be canceled. If the order has been shipped, the normal returns policy will apply. If the package is refused a return freight charge will be added to the credit card.

Orders for custom products cannot be returned for credit.

3. Product Return

Product returns must be made within 14 days from date of purchase, unless otherwise indicated. Customer should go to Delta Heat's website for instructions. Returned product must be in original packaging, unused, undamaged, and in sale able condition. Customer must provide the following information: date of order, original invoice number, and item number.

4. Force Majeure

Delta Heat shall not be liable for any delay in, or impairment of, performance resulting in whole or in part from any force majeure event, including but not limited to: acts of God, labor disruptions, governmental decrees or controls, acts of war, acts of terrorism, insurrections, epidemics, quarantines, shortages, communication or power failures, fire, accident, explosion, inability to procure or ship product or obtain permits and licenses, severe weather conditions, catastrophic events, or any other circumstance or cause beyond the reasonable control of Delta Heat LLC in the conduct of its business.

5. Waiver, Choice of Law and Venue

The failure of either party to assert a right hereunder or to insist upon compliance with any term or condition will not constitute a waiver of that right or excuse any subsequent non-performance of any such term or condition by the other party. All transactions shall be governed by the laws of the State of Texas, excluding its conflict of law, rules, and venue shall either be in the county courts of Cameron County, Texas or the federal courts for the Southern District of Texas.

6. Modification of Terms

Delta Heat's acceptance of any order is subject to customer's assent to all of the terms and conditions set forth at the time the order is placed.

7. Complete Agreement

The terms and conditions in Delta Heat's website are incorporated herein by reference, and constitute the entire and exclusive agreement between customer and Delta Heat.

Privacy

Delta Heat Collects the Following Information

Delta Heat collects various types of information from all of its customers including visitors to its website. Delta Heat’s web server collects general data pertaining to each "site visitor", including the IP address, the domain name, the web page, the length of time spent and the pages accessed while visiting this Site. This information is collected to, among other things: aggregate information from online and offline sources, facilitate system administration, improve the content of this site, customize, and improve the user experience for "site visitors" and customers, and improve customer service generally.

Security

Delta Heat website security is a priority. Delta Heat continually reviews and updates the security methods implemented to protect information transmitted via this site, including measures to secure and protect all personally identifiable information from loss, misuse, and alteration. Delta Heat, however, cannot guarantee that any electronic commerce is totally secure.

Unsubscribing from E-Mail Marketing

Each site visitor can unsubscribe from receiving e-mails containing promotional offers from Delta Heat simply by sending a request indicating such desire to CustomerService@deltaheatllc.com

Delta Heat may update this policy from time to time. Please check this webpage periodically for updates. Policy updates shall be effective the date the change is posted on the site. Notice of any material changes in the manner in which Delta Heat handles personally identifiable information under this policy will be provided on the Site.

Sales Policy

1. Prices

Prices listed and/or quoted are net and are subject to correction or change without notice. Export orders may be subject to other special pricing. Delta Heat reserves the right to accept or reject any order.

2. Sales Tax

Customers are responsible for payment of all applicable state and local taxes if located in Texas, or for providing a valid sales tax exemption certificate.

3. Payment and Credit Terms

Delta Heat accepts Visa, MasterCard, Discover and American Express. Export orders are subject to special export payment terms and conditions. All payments must be made in U.S. dollars (USD).

Warranty Policy

1. Limited Warranty

All Products sold are warranted by Delta Heat LLC. 

After contacting Delta Heat for a Return Goods Authorization (RGA), the customer will be instructed on where to return the product. As designated by the manufacturer, shipping costs may have to be prepaid. Delta Heat’s repair, replacement, or refund of amounts paid by customer for the product, shall be customer’s sole and exclusive remedy.

2. Limitation of Liability

Delta Heat expressly disclaims any liability for consequential, incidental, special, exemplary, or punitive damages. Delta Heat’s liability in all circumstances is limited to, and shall not exceed, the purchase price paid for the product that gives rise to any liability.

3. Warranty Disclaimer

No warranty or affirmation of fact is expressed or implied, other than as set forth in the limited warranty statement above. Delta Heat disclaims any liability for claims arising out of product misuse, improper product selection, improper installation, product modification, mis-repair or misapplication. Delta Heat expressly disclaims any warranty that the products are fit for particular purpose. Delta Heat makes no warranties to those defined as customers in the Magnuson-Moss warranty – Federal Trade Commission Improvement Act.

4. Warranty Product Return

Before returning any product, the customer must email Delta Heat to request an RGA number. The following information must be provide: date of order, original invoice number, item and a description of the defect.

5. Product Compliance and Suitability

Local jurisdictions have varying laws, codes and regulations governing construction, installation, and/or use of products for a particular purpose. Delta Heat does not guarantee compliance or suitability of the products it sells with any laws, codes or regulations, nor does Delta Heat accept responsibility for construction, installation and/or use of a product. It is customer's responsibility to review the product application and all applicable laws, codes and regulations for each relevant jurisdiction to be sure that the construction, installation, and/or use involving the products are compliant.
